1. Acceptance of Terms

By accessing and using THE KIVO TRAVELLER™ platform ("KIVO", "we", "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our platform.

KIVO is a curated luxury home rental platform that connects guests and hosts of characterful properties.

2. Eligibility

To use KIVO, you must be at least 18 years old and have the legal capacity to enter into binding contracts. By creating an account, you represent that all information provided is true, accurate, and complete.

4. Guest Responsibilities

As a guest, you agree to:

• Provide accurate and complete information
• Respect property rules and check-in/check-out times
• Treat the property with care and respect, reporting any damages
• Communicate respectfully with the host
• Comply with all applicable local laws during your stay

5. Host Responsibilities

As a host, you agree to:

• Provide accurate information about the property and amenities
• Maintain the property as described and photographed
• Respond promptly to guest requests and communications
• Keep an accurate and up-to-date availability calendar
• Comply with all local laws and regulations
• Pay the 15% commission fee on each completed booking

6. Intellectual Property

All content on the KIVO platform, including but not limited to text, graphics, logos, images, and software, is the property of THE KIVO TRAVELLER™ and is protected by copyright and other intellectual property laws.

7. Limitation of Liability

KIVO acts as an intermediary between guests and hosts. We do not own, operate, or control the properties listed.

While we strive to ensure the quality of listed properties, we do not guarantee the suitability of any property for specific purposes. KIVO shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform or stays.

8. Privacy and Data Protection

The collection and processing of your personal data is subject to our Privacy Policy, in compliance with GDPR (General Data Protection Regulation) and LGPD (Lei Geral de Proteção de Dados).

9. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes take effect immediately upon publication on the platform. Continued use after changes constitutes acceptance of the new terms.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Portugal. Any disputes shall be resolved in the competent courts of Portugal.
